Overview

Welcome to Wall Systems Co. (“Wall Systems,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website (wallsystemsco.com) and, where applicable, estimates, proposals, and services we provide for drywall, finishing, and interior painting (primarily in New Castle County, Delaware).

By using our website, submitting a quote request, accepting a proposal, or engaging our services, you agree to these Terms. If you do not agree, do not use the site or engage our services.

Our Privacy Policy describes how we handle personal information, including SMS. Please read it together with these Terms.

1. Who we are and what we do

Wall Systems Co. provides professional drywall installation and repair, tape/finish work, and interior painting for commercial and residential interiors (including offices, retail, restaurants, and related spaces), subject to availability, scheduling, and a written scope of work.

Website content (including galleries, blogs, and service descriptions) is for general information. It is not a bid, contract, or guarantee of price, schedule, or suitability for a specific project until confirmed in a written estimate or agreement.

2. Estimates and proposals

• Estimates and proposals are based on information available at the time (site conditions, measurements, photos, owner direction, and assumptions stated in the proposal).
• A proposal is an offer to perform described work for stated pricing (and any stated validity period). It becomes a binding agreement only when accepted according to the method we provide (for example, electronic acceptance / signature through our proposal portal, or another written acceptance we acknowledge).
• Changes in scope, site conditions, materials, or owner direction may require a revised price and schedule (change order).
• Unless otherwise stated in writing, estimates exclude work outside the listed scope (for example, unrelated trades, hazardous materials abatement, structural repairs, or latent conditions not reasonably discoverable).

3. Acceptance, scheduling, and access

After acceptance, we will coordinate scheduling. You agree to provide reasonable access to the work area, necessary utilities where agreed, and timely decisions so work can proceed. Delays caused by access, other trades, or owner decisions may affect schedule and may affect cost if our crew is remobilized.

4. Payments

Payment terms (deposit, progress, final) are as stated in your proposal or invoice. Late or failed payment may pause work and may incur late fees only if stated in writing. Online payment, when offered, is processed by our payment provider; card data is handled by that provider, not stored by us as full card numbers.

5. Workmanship and warranties

Workmanship and warranty expectations are described on our Warranty page and/or your written agreement. Manufacturer warranties, when applicable, are separate from our workmanship obligations. Nothing on the website expands a warranty beyond what is in your signed agreement.

6. Limitation of liability

To the fullest extent permitted by law:

• Our total liability arising out of a project is limited to the amounts you paid us for that project’s contracted scope (or a higher amount if required by non-waivable law).
• We are not liable for indirect, incidental, special, consequential, or lost-profit damages.
• We are not responsible for conditions outside our control or outside our scope (for example, structural movement, moisture intrusion we did not cause, damage by others after our work, or owner-directed deviations from manufacturer specifications).

Some jurisdictions do not allow certain limitations; if so, those limitations apply only to the extent allowed. This section should be reviewed by an attorney for your specific contracts.

7. Website use

You may use the site for lawful purposes only. Do not attempt to disrupt the site, scrape in an abusive way, or submit false information. Content on the site is owned by Wall Systems or its licensors. You may not copy it for commercial reuse without permission.

8. SMS program terms

Wall Systems Co. may offer an optional SMS program for transactional messages about estimates, appointments, and job updates.

Opt-in: You opt in by providing a mobile number and agreeing via a written consent checkbox in our forms/CRM, or by giving verbal consent on site that our staff records (who attested and when). Consent is not a condition of purchasing services in general, but without SMS consent we will not text you.

Message content / frequency: You may receive periodic texts related to your estimate, appointment, and job updates. Frequency varies with project activity.

Message and data rates may apply. Reply HELP for help. Reply STOP to cancel. You may also ask us to remove SMS consent from your record.

We do not sell or share mobile numbers with third parties for their marketing. Details are in our Privacy Policy. Carriers are not liable for delayed or undelivered messages.

9. Privacy

Personal information is handled as described in our Privacy Policy. By using the site or providing contact details, you acknowledge that policy.

10. Indemnity

You agree to indemnify and hold Wall Systems harmless from claims arising from your misuse of the site, inaccurate information you provide, or your breach of these Terms, to the extent allowed by law. This section should be reviewed by an attorney.

11. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections of another jurisdiction apply. Venue for disputes will be in courts located in Delaware, unless applicable law requires otherwise.

12. Changes

We may update these Terms. The “Last updated” date will change when we do. Material changes to SMS program terms will be reflected here and/or in our Privacy Policy. Continued use after updates constitutes acceptance of the revised Terms where permitted by law.
